Terms and Conditions of Use


First Things First and its Arizona Registry contractors (“FTF”) provide services related to professional development of child care providers through the azregistry.org and azearlychildhood.org websites (“Services”). FTF provides these Services subject to the following terms and conditions (“Terms”).

  1. Acceptance. By using the Services, you agree to these Terms. Using the Services includes accessing, providing information or data of any kind from whatever source or in any form (“Content”) to, or using one or both of the websites. If you use a particular service on or through the websites, you will be subject to any additional rules or guidelines that are applicable to those services.
  2. Access to Services. FTF reserves the right to, with or without notice and without any liability to you, (i) modify or discontinue the Services, including the websites, and your individual access to the Services, whether temporarily or permanently and (ii) delete in whole or in part any Content you provide, whether temporarily or permanently. FTF is not responsible or liable for the timeliness, deletion, failure to store, inaccuracy, or improper delivery of any data or information, including Content, on the websites or for your inability to access such data or information.
  3. Trademark Notice. “RegistryOne” and the “RegistryOne” logo are trademarks and service marks of ChildCare Education Institute, LLC. All other trademarks, service marks, and logos used in the websites are the trademarks, service marks or logos of their respective owners.
  4. Registration. Parts of the websites may require you to register. When you register, you will provide truthful, accurate, and complete information. By registering, you represent and warrant that (a) you are at least fourteen (14) years old and (b) all Content that you provide is accurate. If FTF requests further documentation to process your registration application, you will submit the requested information within 30 days. FTF must verify your education, professional development and credential information before it counts in your Career Lattice level. You shall submit the necessary documents for FTF to make the verification. You will promptly update your Content, including your registration information, to keep it accurate. This includes your contact information, position title, employer, professional development, credentials, and credit coursework completed. You are solely responsible for (a) maintaining the confidentiality of your password and (b) for all uses of the websites by any person who logs on under your registration, user account, or password, whether authorized or unauthorized by you. You shall immediately notify FTF of any unauthorized use of your registration, user account, or password.
  5. Privacy Policy. Registration data and other personally identifiable information that FTF may collect is subject to the terms of the Privacy Policy. The Privacy Policy is incorporated into these Terms by reference.
  6. Links. The FTF websites may contain links to third-party websites or resources. FTF is not responsible for the availability of such third-party websites or resources and does not endorse and is not responsible or liable for any information, advertising, services, products or other materials on or available from such websites or resources. FTF shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such information, goods or services available on or through any such website or resource.
  7. Professional Development Opportunities. Your correspondence or business dealings with registered professional development providers and instructors or registered actual or potential recipients of such instruction, including payment and delivery of goods or services and any other terms, conditions, warranties, or representations associated with such dealings, are solely between you and the other party. FTF shall not be responsible or liable for any loss or damage of any kind incurred as a result of such correspondence or dealings and does not guarantee the quality or value of any professional development course offered on the websites by registered parties.
  8. Your Conduct. All Content publicly or privately provided shall be the sole responsibility of the person providing such Content or the person whose user account is used when providing the Content. The websites may expose you to Content that may be objectionable or offensive to you individually. FTF shall not be responsible or liable to you in any way for the Content that appears on the websites or for any error or omission thereof. All opinions contributed to the websites are those of individual guest users and do not reflect the opinions of the employees or management of FTF.

    When you use the Services, you shall not (a) provide any Content or perform any conduct that may be unlawful, illegal, threatening, harmful, abusive, harassing, stalking, tortuous, defamatory, libelous, vulgar, obscene, offensive, objectionable, or pornographic; that is designed to or does interfere or interrupt any Services; that is infected with a virus or other destructive or deleterious programming routine; that gives rise to civil or criminal liability; or that may violate an applicable local, national, or international law, including laws relating to copyrights, trademarks, patents, or trade secrets; (b) impersonate or misrepresent your association with any person or entity or forge or otherwise seek to conceal or misrepresent the origin of any Content provided by you; (c) collect or harvest any data about other users other than data necessary to provide a professional development course from users who register for the course; or (d) use the Services or any Content in any commercial manner outside of the purpose of the Arizona Registry or in any manner that would involve junk mail, spam, chain letters, pyramid schemes, or any other form of unauthorized advertising without prior written consent.

    By providing any Content: (a) you warrant and represent that you have all legal rights that are associated with the Content; (b) you grant FTF a worldwide, royalty-free, perpetual, irrevocable, nonexclusive, fully transferable license and any other necessary right to use, display, reproduce, modify, adapt, publish, translate, distribute, archive, create derivative works from, and create compilations of, in whole or in part, such Content throughout the world in any media in connection with the Services; and (c) FTF shall have the right (but not obligation), in its sole discretion, to refuse to publish or to remove or block access to any such Content at any time and for any or no reason, with or without notice.

  9. Fraud. FTF desires to ensure the accuracy and integrity of all Content and may review any submitted Content, including applications and documentation, for fraud. The review may include cross-checking dates of employment, education, certifications, and trainings; checking documents for evidence of physical tampering (i.e., white-out of signatures, dates, titles, etc.); and emailing current employers to verify your start date, current position, age group worked with, salary, and other related information. If FTF has cause to believe you may have submitted inaccurate information, you shall address the alleged false information and furnish additional documentation. Information suspected as fraudulent or otherwise inaccurate will not be entered into your profile, and a note regarding the suspected fraud will be entered into your profile and folder. FTF may also notify your employer and other FTF programs and outside organizations providing financial aid or services to you of the information FTF believes to be fraudulent or otherwise inaccurate. If you wish to report fraudulent activities by another user of the Services, you must submit the information to FTF in writing.
  10. Indemnification. You hereby irrevocably indemnify and hold FTF (including related parties, officers, officials, directors, employees, agents, independent contractors, advertisers, and partners) harmless from and against any and all claims, actions, liabilities, damages, losses, or expenses (including court costs, attorneys’ fees, and costs of claim processing, investigation and litigation) (“Claims”) for bodily injury or personal injury (including death), or loss or damage to tangible or intangible property caused, or alleged to be caused, in whole or in part, by your negligent or willful acts or omissions that is due to or arising out of your conduct or connection with the Services, including your provision of Content, your violation of these Terms, or any other violation by you of the rights of another person or party. You further indemnify and hold FTF harmless from and against any and all Claims arising out of or connected with your professional placement on the Career Lattice. It is agreed that you will be responsible for primary loss investigation, defense and judgment costs where these indemnifications are applicable. This indemnity paragraph shall not apply if you are an agency, board, commission or university of the State of Arizona.
  11. Warranty Disclaimer. THE WEBSITES, INCLUDING ANY CONTENT OR INFORMATION CONTAINED WITHIN THEM OR ANY SITE-RELATED SERVICES, ARE PROVIDED "AS IS," AT YOUR OWN RISK, AND WITH NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. YOU ASSUME TOTAL RESPONSIBILITY AND RISK FOR YOUR USE OF THE WEBSITES AND SITE-RELATED SERVICES. FTF IS NEITHER RESPONSIBLE NOR LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, PUNITIVE, OR OTHER DAMAGES ARISING OUT OF OR RELATING IN ANY WAY TO THE WEBSITES, THE USE OF MISUSE OF THE WEBSITES, SITE-RELATED SERVICES, UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA TRANSMISSIONS BY THIRD PARTIES, OR THE CONTENT OR INFORMATION CONTAINED WITHIN THE WEBSITES. YOUR SOLE REMEDY FOR DISSATISFACTION WITH THE WEBSITES OR SITE-RELATED SERVICES OR CONTENT IS TO STOP USING THE WEBSITES AND SUCH SERVICES. FTF MAKES NO WARRANTY, IMPLIED OR EXPRESSED, THAT ANY PART OF THE WEBSITES OR SERVICES WILL BE UNINTERRUPTED, ERROR FREE, VIRUS FREE, TIMELY, SECURE, ACCURATE, RELIABLE, OR OF ANY QUALITY OR THAT ANY CONTENT IS SAFE IN ANY MANNER FOR DOWNLOAD. FTF DOES NOT PROVIDE PROFESSIONAL ADVICE, AND YOUR USE OF SUCH ADVICE OR ANY OTHER INFORMATION IS SOLELY AT YOUR OWN RISK AND WITHOUT OUR LIABILITY OF ANY KIND. FTF makes no guaranties as to the correctness or accuracy of the websites or the Content. It is possible that the websites could include inaccuracies or errors and that unauthorized additions, deletions, and alterations could be made to the websites by third parties. If an inaccuracy arises, you may inform FTF so that it can be corrected.
  12. Reservation of Rights. FTF reserves the right to change these Terms at any time without notice to you. The most current version of the Terms is available on the websites.
  13. Applicable Law/Jurisdiction. These Terms and any dispute arising out of or related to your use of the Services shall be governed by and construed in accordance with the laws of the State of Arizona. All disputes arising out of these Terms or the Services shall be exclusively subject to the jurisdiction and venue of the state and federal courts sitting in the state of Arizona.
  14. Miscellaneous. The failure of either party to assert any right under these Terms shall not he considered a waiver of any that party's right, and that right will remain in full force and effect. These Terms, as modified, and the provisions incorporated by reference herein, constitute the entire agreement between the parties pertaining to the subject matter hereof, and any and all prior written or oral agreements existing between the parties are expressly canceled. FTF may assign its rights and obligations under these Terms to a successor in interest to its business, whether by merger, sale of assets, or otherwise. If any of the provisions of these Terms are held by a court or other tribunal of competent jurisdiction to be unenforceable, such provisions shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect. To the extent required by A.R.S. § 12-1518, the parties agree to resolve all disputes arising out of or relating to these Terms through arbitration. Notice is hereby given of A.R.S. § 38-511 regarding cancellation of contracts for conflicts of interest.
